Introduction
This document outlines the terms and conditions for the use of all products provided by ButterDogCo linking to this document, herein referred to as "The Company", or "The Distributor". The members of the ButterDogCo GitHub organization, administrators of the ButterDogCo Discord Server, are referred to as "The Employees", "The Developers", or "The Administrators". The services provided by ButterDogCo, such as Wikabedia, are referred to as "The Products" or "The Services". The persons who use this service are collectively referred to as "The Customers", "The Users", or "The Clients".
By agreeing to the terms outlined below, the user agrees to be bound by the rules and regulations of this document, as well as any other rules and regulations that may be provided by the company in the future. If a user does not agree to these terms, they are prohibited from using any services provided by the company.
If a user who has agreed to the terms, and is therefore obligated to follow them, breaks said terms, the following rules apply:
- The company reserves the right to remove or restrict access to users from any products or services, as detailed in the Terms of Use section of this document.
- The company reserves the right to contact the appropriate authorities in the event that the consequences directly or indirectly lead to serious damages to the company that could result in:
- A takedown, whether complete or partial, of the services provided by the company
- Legal action against the company, its employees, or its services
If at any moment a user lies about their usage intentions, their criminal record, illegal possession of products, or any other such item determined by the company at its discretion, the company has the right to suspend or terminate their account and refuse any and all current or future use of the products (or any portion thereof). If at any moment, there are multiple competing terms, for example, these terms and the implied terms of a distributed product, the specific terms in this document are the ones which take superiority. To the extent local law (The laws, regulations, and arbitrations of the state of Oregon) conflicts with these terms, local law will control always takes superiority over the terms in this document, as detailed in the Governing Law section of this document.
In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy controls for privacy-related matters to the extent of the conflict.
Terms of Use
By using the services provided by the company, in addition to the rules listed above, users also agree to the following terms, regardless of whether or not this document has been read or signed off on. By using any one service provided by the company, the customer automatically agrees to the terms and conditions of all services provided by the company.
- It is prohibited to use the services provided by the company to visit illegal sites, such as:
- Pornography or erotica services accessibile to minors (under 18 years of age, or as otherwise considered a minor by local law)
- Narcotics trade services, including pharmacies
- Arms trading services
- It is prohibited to use the services of the company to plan out acts of terror, including but not limited to:
- Bombings
- Shootings
- Poisonings
- Kidnappings
- Mental or physical harm of any kind
- Hacking of any kind, including but not limited to:
- Spamming
- DDoS (Distributed Denial-of-Service) attacks
- Phishing
- Cheating/Exploit software
- Cryptomining
- The services of the company are a privilege, not a right. The company and its employees have the right to remove access to the provided products at any time. In such cases, the company is obligated to give no notice to the userbase, and is not obligated to provide an explanation for the removal of access, as detailed in the Limitations of Liability section of this document.
- If, for any reason, a user's account has been removed by the company, they are not allowed to registering a new account under their name, a fake or borrowed name, or the name of any third party, even if they may be acting on behalf of the third party. In addition to terminating or suspending their account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
- The company is not liable for any defamation made by its customers. Customers are entirely responsible for representing themselves in legal cases against a third party that they have defamed or otherwise made a bad comment against.
- The company is not liable or responsible for any damages, whether physical or psychological, that may occur or arise while using the provided services. Users are expected to consult their medical professionals before utilizing the company's products, regardless of whether or not such disclaimers exist on those products.
- The company is not liable or responsible for any disciplinary action taken against its customers for using the services it provides. If legal action is mandated, the company will not provide legal help for convicted users and, if necessary, will fight against the user in the name of self-preservation.
- It is prohibited to access or use products through a bot, script, or other automated or non-human methods, unless explicitly authorized either in these terms or the rules of the product in question.
- The user is fully liable and responsible for any incidents that occur on third-party services or products connected to any of the services provided by the company, and likewise, any third-party services or products that lead to any of the services provided by the company.
Code Of Conduct
In addition to the rules expressed in the introduction, users are prohibited from the following actions:
- Tricking, defrauding, or misleading the company, the employees, and other users, especially in any attempt to learn sensitive account information such as user passwords
- Using any information obtained from the services in order to harass, abuse, or harm another person
- Making improper use of provided support services or submitting false reports of abuse or misconduct
- Attempted or successful impersonation of a user or person, or use of the username of another user
- Using the services provided by the company for any illegal or unauthorized purpose, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses
- Interfering with the proper working of the services provided by the company
Intellectual Property Rights
Unless otherwise indicated, the company is the sole owner and manager of all provided services and products, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (herein referred to as "The Content"), as well as any trademarks, service marks, and logos contained therein (herein referred to as "The Marks"). Unless otherwise indicated through these terms and only these terms, no part of the products, content, or marks provided by the company may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without prior written permission from the company. Furthermore, it is prohibited to utilize access to provided services to compete with the company in any form.
If, for any reason, a user loses access to the company's services, they are obligated to delete any and all private and personal backups to those services, to the extent technically feasible. That is, local downloads and copies exist for the sole purpose of accessing provided content when the primary source of distribution is experiencing difficulties.
Distribution Of Content
Users are prohibited from sharing or distributing services with:
- Individuals who have been barred from using the products by the company or these terms
- Individuals who live in regions whose laws prevent the use of any of the products in the product base of the company
Contributing
First and foremost, the company does not assert ownership over any user-made contributions. Users retain full ownership of the contributions they provide, as well as any proprietary rights for their contributions. The company is not liable or responsible for any statements or representations in your contributions provided by you in any product given out by the company, or contributed user content.
By providing contributions to the company, users agree that the contributions:
- Are not false, inaccurate, or misleading
- Are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation
- Are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by the company)
- Do not ridicule, mock, disparage, intimidate, or abuse anyone, including legal harassment or threatening of any other person, and do not promote violence against a specific person or class of people
- Do not violate any applicable law concerning child pornography or are otherwise intended to protect the health or well-being of minors
- Do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap
- Do not otherwise violate or link to material that violates any provision of these terms or any applicable law or regulation
The company has the right to modify any part of any user-made contribution. If the company modifies a core part of the contribution, such as the code, visual media (excluding favicons and other identification icons), or audio media (excluding haptic response feedback and login/boot/error sounds), the company is now in possession of a separate item from the original contribution, or as otherwise stated in the product's contributing or license document.
User Feedback And Submissions
The company may, at times, provide channels for clients to submit feedback regarding a provided service. Feedback given through improper channels will be ignored, as well as any feedback about any provided services that themselves do not provide channels for clients to submit feedback. Users are not allowed to use feedback channels of one service to provide feedback for another service, regardless of whether the two are connected in any way, including but not limited to web frames, links, or advertisements.
Users agree that their feedback is entirely truthful and is constructive criticism aimed not to defame the company, its employees, or its services, but rather to provide suggestions on changes the company could make.
Updates
The company may, at any time, update or modify the provided services, content, or marks. The company is obligated to provide a 10-day notice to the userbase before said changes are in effect, unless the changes are considered minor, in which case the company is not obligated to provide any notice. The company may send notifications of updates through one or multiple of the following methods:
- A news post on the company's website
- An announcement message in the Discord server
- A message sent to the email address associated with the user's account
The following changes to the terms and conditions of ButterDogCo are not subject to the 10-day notification period for other changes:
- Fixing typographical errors, inaccuracies, or omissions
In the event that a user does not agree to the changes made to the terms and conditions, they are obligated to stop using the services provided by the company and delete any and all copies of the services, content, or marks provided by the company, including but not limited to local downloads and backups. Users retain the right to contact the company to express their disagreement with the changes made to the terms and conditions, but the company is not obligated to respond to such messages, and terms and conditions stated in this document and privacy policy are still in effect when contacting the company regarding disagreements with changes made to the terms and conditions.
Limitations of Liability
Under no circumstances will the company or its employees be liable to any user or third party for any direct, indirect, exemplary, incidental, special, or punitive damages, including but not limited to lost profit, lost revenue, or lost data, even if warnings or advice have been given to the company regarding the possibility of such damages.
The company is not liable for any downtime of any of its products or services, whether intentional or not, whether through hardware, software, or firmware problems, or other issues that may arise to the extent not prohibited by law. The company is not obligated to announce planned downtimes or provide an explanation for any downtime, intentional or not. The company is furthermore not obligated to notify the userbase about any change, revision, update, suspension, or discontinuation of any of its products or services. If any product or service provided by the company is blocked through any means, neither the company nor its employees is required to supply a backup or alternative access point to the blocked product or service. No part of these terms may be used to force the company to update any of its products or services for any reason; the company is the sole entity that decides what changes are made and when.
Governing Law
These terms and conditions are governed by the laws of the state of Oregon, United States of America. Any disputes arising from these terms and conditions will be resolved in the courts of Oregon, and users agree to submit to the jurisdiction of such courts.
